NoctIQ Inc. ("NoctIQ," "we," "us," or "our") is committed to protecting the privacy and security of your personal information. This Privacy Policy ("Policy") describes the types of information we collect from and about you when you use our products and services, how we use and share that information, and the choices and rights available to you. This Policy applies to our website at noctiq.com, the NoctIQ mobile application (iOS and Android), and the NoctIQ smart anti-snore pillow and related hardware (collectively, the "Services").
⚠ Critical Privacy Notice — Local-Only Audio Processing
The NoctIQ App may use your mobile device's microphone to record snoring audio for the purpose of analyzing your sleep patterns. ALL audio recordings are processed and stored EXCLUSIVELY on your device (locally). NoctIQ does NOT upload, transmit, access, collect, or store any audio recordings on its servers at any time.
This local-only processing architecture is a deliberate design decision made to protect your privacy. You retain complete control over your audio data and may delete it at any time through the App.
1. Introduction and Overview
1.1 General
This Policy describes the types of information we collect from and about you when you use our Services, how we use and share that information, and the choices and rights available to you regarding your information.
1.2 Scope
Your continued access to or use of the Services after any modifications to these Terms constitutes your acceptance of such modifications. It is your responsibility to review these Terms periodically for changes.
1.3 Acceptance
By accessing or using any of the Services, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree with the practices described in this Policy, you should not use the Services.
1.4 Company Information
NoctIQ Inc. is a corporation organized under the laws of the State of Delaware, with its principal place of business at 5705 Oak Mill Court, Glen Allen, VA 23059.
2. Important Notice About Audio Data
2.1 Local-Only Processing
When you enable snoring detection features within the App, the App may request access to your device's microphone. Any audio captured through this feature is processed entirely on your device using on-device algorithms. Audio data is not transmitted to NoctIQ servers, third-party servers, cloud infrastructure, or any external system.
2.2 No Server-Side Storage of Audio
NoctIQ does not maintain, store, or have access to any audio recordings created through the App's microphone feature. NoctIQ's servers do not receive, process, or retain audio data in any form, including raw audio files, compressed audio, spectrograms, or audio-derived waveforms.
2.3 User Control
You may delete any and all audio recordings stored on your device at any time through the App's settings. Once deleted from your device, the audio data is permanently removed. Because NoctIQ does not possess copies of your audio data, NoctIQ cannot recover deleted audio recordings.
2.4 Distinction Between Audio and Non-Audio Data
While audio recordings remain exclusively on your device, the App does derive certain non-audio sleep and snoring metrics (such as snore duration, snore event counts, and snoring intensity scores) from sensor data and device processing. These non-audio, derived data points — which do not contain sound recordings or audio content — may be transmitted to NoctIQ servers as described in Section 3.
3. Information We Collect
3.1 Account Information
When you create a NoctIQ account, we collect your email address, a password (stored in cryptographically hashed form), and a display name selected by you.
3.2 Optional Profile Information
You may voluntarily choose to provide additional profile information to enable more personalized sleep recommendations, including gender, age, weight, height, and sleeper type (e.g., back sleeper, side sleeper). You are under no obligation to provide this information and may modify or remove it at any time.
3.3 Sleep and Snoring Data (Non-Audio)
In connection with your use of the Pillow and the App, we collect non-audio sleep and snoring data including sleep duration, snore duration, number of snore events, snore decibel levels, snore type classification, snoring intensity scores, and breathing pattern data. This data consists of numerical and categorical metrics — no sound recordings or audio content of any kind are transmitted to NoctIQ.
3.4 Device and Pillow Data
We collect data generated by and about the Pillow and your connected devices, including pressure sensor readings, inflation data and inflation event logs, firmware version and diagnostic logs, and metadata about the WiFi-connected device used to operate the Pillow.
3.5 Usage and Analytics Data
We collect information about how you interact with the App and Website, including pages and screens visited, features accessed, session duration, click and tap interactions, crash logs and error reports, and general usage patterns.
3.6 Transaction and Payment Data
When you make a purchase, we collect transaction-related information including purchase history, order details, and subscription status. Payment card details and other financial information are processed by third-party payment processors. NoctIQ does NOT directly collect, process, or store payment card numbers on its servers.
3.7 Communications Data
When you contact us for customer support, submit feedback, or otherwise communicate with NoctIQ, we collect the content and metadata of those communications.

4. How We Use Your Information
4.1 Providing and Maintaining the Services
We use your information to operate, deliver, and maintain the Services, including to create and manage your account, facilitate Device connectivity, and ensure the proper functioning of the App, Website, and Pillow.
4.2 Personalization and Recommendations
We use your sleep data, snoring metrics, profile information, and Device data to generate personalized sleep recommendations, optimize Pillow inflation and positioning, and provide tailored insights about your sleep patterns.
4.3 Processing Transactions
We use your information to process purchases, manage subscriptions, fulfill orders, and provide transaction-related communications such as order confirmations and shipping notifications.
4.4 Communications
We use your information to respond to your inquiries, provide customer support, send service-related notices (such as updates, security alerts, and administrative messages), and, with your consent where required by applicable law, send promotional communications.
4.5 Product Improvement and Development
We use your information to understand how our Services are used, identify areas for improvement, develop new features and products, conduct internal testing, and improve the overall user experience.
4.6 Analytics and Research
We use aggregated and anonymized data for analytics, research, trend analysis, and statistical purposes. When data is aggregated and anonymized such that it can no longer reasonably be used to identify you, it is no longer considered personal information under this Policy.
4.7 Security and Fraud Prevention
We use your information to detect, investigate, and prevent fraudulent transactions, unauthorized access, and other illegal activities, and to protect the rights, property, and safety of NoctIQ, our users, and the public.
4.8 Legal Compliance
We use your information as necessary to comply with applicable laws, regulations, legal processes, or enforceable governmental requests, and to enforce our Terms of Service and other agreements.
5. How We Share Your Information
5.1 No Sale of Personal Information
NoctIQ does NOT sell your personal information to third parties. We have not sold personal information in the preceding twelve (12) months and do not have plans to do so.
5.2 Service Providers
We may share your information with third-party service providers who perform services on our behalf, including: Shopify, Inc. (e-commerce and payment processing); cloud hosting providers; analytics providers; third-party payment processors; and customer support platforms. All service providers are contractually obligated to use such information only for the purposes for which it was disclosed.
5.3 Legal Compliance and Protection
We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable law, enforce our Terms of Service, detect or prevent fraud or security issues, or protect the rights, property, or safety of NoctIQ, our users, or the public.
5.4 Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of NoctIQ's assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or uses of your personal information.
5.5 With Your Consent
We may share your information with third parties when you have given us your explicit consent to do so.
5.6 Aggregated and De-Identified Data
We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you with third parties for research, analytics, marketing, or other purposes.
6. Account Deletion and Subscription Management
6.1 Account Deletion
You have the right to delete your NoctIQ account and all associated personal data at any time. You can delete your NoctIQ account and associated cloud data:
- In the app: Profile → Account → Delete Account; or
- Online (no app required): visit https://noctiq.backrobo.online/delete-account.html and confirm with your account email and password; or
- By email: contact care@noctiq.com from your registered email.
When you delete your account we will automatically cancel any active subscriptions purchased on our website and stop future billing. Deletion removes your account, profile, sleep and snore data, and pillow binding from our servers. Audio recordings are stored only on your device and are removed when you uninstall the app. Records we are legally required to retain such as purchase and billing records are kept only as long as required and will be retained in accordance with this Privacy Policy.
6.2 Subscription Management & Cancellation
In-App Purchases (Apple App Store / Google Play):** If you purchased your premium subscription through an in-app purchase, your billing is handled directly by Apple or Google. To cancel or manage your subscription, you must use your mobile device's account settings, or log into your subscription dashboard via a web browser at account.apple.com or play.google.com. Deleting your mobile account inside the app does not automatically cancel your App Store subscription; you must cancel it via the store platform to stop recurring billing.
* **Direct Web Purchases:** If you purchased a subscription or premium access directly through our website, you can manage, pause, or cancel your subscription at any time by logging into your account dashboard at noctiq.com or by emailing support@noctiq.com.
7. Third-Party Services
7.1 Third-Party Providers
The Services integrate with or rely upon third-party services including: Shopify (e-commerce and payment processing); analytics services (usage patterns, crash reporting, and App performance monitoring); cloud hosting providers (data storage and server infrastructure); payment processors (financial transactions); and customer support platforms (support tickets, live chat, and user correspondence).
7.2 Independent Policies
Each third-party service provider maintains its own privacy policy governing its collection, use, and disclosure of information. We encourage you to review the privacy policies of any third-party services you interact with in connection with the Services.
7.3 No Responsibility for Third Parties
NoctIQ is not responsible for the privacy practices, data collection, or content of any third-party services.
8. Data Retention
8.1 General Retention Principles
We retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was collected and to comply with our legal obligations, resolve disputes, and enforce our agreements.
8.2 Account Data
We retain your account information for as long as your account remains active. Following a deletion request or account closure, we will delete or anonymize your account data within a commercially reasonable period, except as required to comply with legal obligations.
8.3 Sleep and Device Data
Sleep metrics, snoring data, and Device data are retained for the duration of your active account and for a reasonable period thereafter to allow for account recovery. You may request deletion of this data at any time as described in Section 9.
8.4 Transaction Data
Transaction records and purchase history are retained for the period required to comply with applicable tax, accounting, and financial reporting obligations, which may extend beyond the termination of your account.
8.5 Aggregated and Anonymized Data
Data that has been aggregated and anonymized such that it can no longer reasonably identify you may be retained indefinitely for research, analytics, and product improvement purposes.
8.6 Audio Data
NoctIQ does not retain any audio data. Audio data exists solely on your device and is subject to your control and your device's storage management.
9. Data Security
9.1 Security Measures
NoctIQ implements industry-standard administrative, technical, and physical safeguards including: encryption of data in transit using TLS protocols; encryption of data at rest using industry-standard algorithms; access controls limiting access to authorized personnel; regular security assessments and vulnerability testing; and secure storage of passwords using cryptographic hashing.
9.2 No Guarantee
While we strive to protect your personal information, no method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your information.
9.3 User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. We encourage you to use a strong, unique password and to notify us immediately at care@noctiq.com if you believe your account has been compromised.
9.4 Breach Notification
In the event of a data breach that affects your personal information, we will notify you and applicable regulatory authorities in accordance with applicable law.
10. Your Rights and Choices
10.1 Right to Access
You have the right to request confirmation of whether we are processing your personal information and to obtain a copy of the specific personal information we have collected about you.
10.2 Right to Deletion
You have the right to request that we delete the personal information we have collected from you, subject to certain exceptions as provided by applicable law.
10.3 Right to Correction
You have the right to request that we correct inaccurate personal information that we maintain about you.
10.4 Right to Opt Out of Sale
NoctIQ does not sell personal information. However, to the extent required by applicable law, you have the right to opt out of any future sale of your personal information.
10.5 Right to Data Portability
You have the right to request that we provide a copy of your personal information in a structured, commonly used, and machine-readable format, to the extent technically feasible.
10.6 Right to Non-Discrimination
We will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services or charge you different prices as a result of your exercise of any privacy right.
10.7 How to Exercise Your Rights
To exercise any of the rights described in this Section, you may: (a) email us at care@noctiq.com with the subject line "Privacy Rights Request"; or (b) contact us via live chat at noctiq.com.
10.8 Account Settings
You may access, update, or modify your account information and profile data at any time by logging into your NoctIQ account through the App or Website and navigating to your account settings.
10.9 Marketing Communications
You may opt out of receiving promotional communications from NoctIQ at any time by clicking the "unsubscribe" link in any marketing email, adjusting your notification preferences in the App, or contacting us at care@noctiq.com. Service-related communications (account notifications, security alerts, and transactional messages) will continue regardless of marketing preferences.
10.10 Deleting Audio Data
Audio recordings stored on your device may be deleted at any time through the App's settings. Because audio data is stored exclusively on your device and is not transmitted to NoctIQ, deletion is managed entirely through your device and the App.
11. Children's Privacy
11.1 Age Restriction
The Services are not directed to, and are not intended for use by, individuals under the age of eighteen (18). NoctIQ does not knowingly collect, solicit, or maintain personal information from anyone under the age of 18.
11.2 Parental Notification
If we learn that we have collected personal information from a person under the age of 18, we will take prompt steps to delete such information. If you are a parent or guardian and believe your child has provided personal information to NoctIQ, please contact us immediately at care@noctiq.com.
12. State-Specific Privacy Rights
12.1 California Residents — CCPA/CPRA
NoctIQ does not sell personal information as defined under the CCPA and does not share personal information for cross-context behavioral advertising. California residents may request information regarding the disclosure of their personal information to third parties for direct marketing purposes. NoctIQ does not disclose personal information to third parties for their direct marketing purposes. 12.2 Virginia Residents — VCDPA
Virginia residents have the right to confirm whether NoctIQ is processing your personal data; access your personal data; correct inaccuracies; delete your personal data; obtain a portable copy; and opt out of the processing of personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. To exercise these rights or appeal a decision, contact us at care@noctiq.com with the subject line "VCDPA Appeal."
12.3 Other State Privacy Laws
Residents of Colorado, Connecticut, and other states with comprehensive privacy laws have rights similar to those described above. As additional state privacy laws take effect, NoctIQ will comply with applicable requirements and update this Policy accordingly. 13. International Users
13.1 United States Operations
The Services are operated from and intended for use in the United States. If you access or use the Services from a location outside the United States, your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
13.2 No Representation of Compliance
NoctIQ does not represent or warrant that the Services or this Policy comply with the privacy laws of any jurisdiction other than the United States.
14. Do Not Track Signals
14.1 DNT Disclosure
The Website does not currently alter its data collection and use practices in response to "Do Not Track" (DNT) signals from web browsers, as there is no universally accepted standard for how companies should respond to DNT signals.
14.2 Global Privacy Control
Where required by applicable law (such as the CCPA), NoctIQ will honor Global Privacy Control ("GPC") signals as a valid opt-out request for the sale or sharing of personal information.
15. Changes to This Privacy Policy
15.1 Right to Modify
NoctIQ reserves the right to modify, amend, or update this Policy at any time at its sole discretion. When we make changes, we will revise the "Last Updated" date at the top of this document.
15.2 Notice of Material Changes
If we make material changes that affect your rights or the way we collect, use, or share your personal information, we will notify you by sending an email to the email address associated with your account and/or by providing a prominent notice within the App or on the Website prior to the changes taking effect.
15.3 Continued Use
Your continued use of the Services after the effective date of any revised Policy constitutes your acceptance of the revised Policy. If you do not agree with the revised Policy, you should discontinue your use of the Services and delete your account.
